JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is an accused in Ghorasahan P.S. Case No. 226/2016 for the offence under section 392 of the Indian Penal Code.

In paragraph-3 there is statement on affidavit that petitioner has fair antecedent.

FIR was lodged against unknown. From the seizure list, it appears that one extreme motorcycle bearing No. BR05L2269 was seized and co-accused Rakesh Kumar Kushwaha was apprehended alongwith the motorcycle. The said Rakesh Kumar Kushwaha was granted bail by this court in Cr. Misc. No. 28968 of 2017 vide order dated 03.07.2017.

Since the petitioner was not named in the FIR and as

Patna High Court Cr.Misc. No.27654 of 2017 (2) dt.07-07-2017 2/2 per statement in paragraph-3 that he has fair antecedent and considering the fact that co-accused Rakesh Kumar Kushwaha has already been granted bail in Cr. Misc. No. 28968 of 2017 vide order dated 03.07.2017, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Sikarahana at Dhaka, East Champaran, in connection with Ghorasahan P.S. Case No. 226 of 2016 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
