The petitioner apprehends his arrest in Nawkothi P.S.Case No. 84/2013 instituted for offences punishable under Sections 304 (B), 201/34 of the Indian Penal Code.

The prosecution case is that the marriage of the informant's daughter Madhu Devi was solemnized one and half years ago with Lalindar Mahton, petitioner. When the victim came to her Naiher, she complained that her mother-in-law, father-in-law, brother-inlaw and sister-in-law tortured her physically and mentally and demanded motorcycle as dowry. It was also stated by the informant (father of the victim) that her parents compelled the victim to go to her matrimonial house. The informant further alleged that the accused persons attempted to kill his daughter

Patna High Court Cr.Misc. No.2011 of 2015 (3) dt.13-05-2015 2/2 Madhu Devi by burning her for which after receiving the burn injury, they brought her to Doctor S.B. Sharma but did not inform about the treatment. The informant got information regarding the incident on 12.11.2013 by unknown person and on his arrival he found the dead body of his daughter. From para-16 of the case diary, which is also annexed to Annexure-2 of this application, is the fardbeyan of the victim Madhu Devi, who has deposed on 3.11.2013 at 12 A.M. that burn injury received by her, was not attributing to any one.

Learned counsel for the petitioner submits that while cooking meal, she sustained such burn injury. The Fardbeyan of the victim Madhu Devi does not implicate the petitioner for the affairs.

Under such circumstances, it is directed that in the event of arrest or surrender within a period of four weeks from today, the above named petitioner Lalindar Mahton shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand)with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in Nawkothi P.S. Case No. 84/2013, subject to condition as laid down under Section 438 (2) of Cr.P.C.
