Heard learned counsel appearing on behalf of the petitioner as well as learned Additional Public Prosecutor appearing for the State.

Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. In view of the report contained in letter no.94 dated 02.12.2021, this Court is not inclined to enlarge the petitioner on bail.

In view of the report submitted by learned Second Additional District & Sessions Judge, Bhagalpur that the trial will be concluded within six months the court below is directed to conclude the trial expeditiously preferably within a period of four months from the date of this order. The learned court below

Patna High Court CR. MISC. No.24154 of 2021(5) dt.17-01-2022 2/2 is further directed to conduct the trial in virtual mode of the remaining witnesses. In case no substantial progress take place in trial the petitioner, if so, advised may renew his prayer for bail after the aforesaid period.

Accordingly, the present criminal miscellaneous application stands dismissed.
