Petitioner seeks regular bail in connection with Masrakh Excise PS Case No. 01/2022 registered for the offence punishable under Sections 30(a)(b)/32(2)(3) of Bihar Prohibition & Excise Act, 2016.

The police recovered 4221 litres of illicit liquor from a truck bearing Registration No. WB51A9017 and arrested its driver (petitioner).

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and is in custody since 02.01.2022. The petitioner being driver of the said truck was not aware about the illicit liquor being kept therein and he was plying the truck at the instance of its owner. No illicit liquor has been recovered from his conscious possession.

No.14576 of 2022(2) dt.25-05-2022 2/2 Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner having no criminal antecedent is in custody since 02.01.2022, he being driver of the truck was not aware about the illicit liquor being kept therein and no illicit liquor has been recovered from his conscious possession, I am inclined to grant regular bail to the petitioner subject to the condition that one of the bailors will be a local resident of territorial jurisdiction of the court below.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Exclusive Special Judge Excise Saran at Chapra in connection with Masrakh Excise PS Case No. 01/2022.
