The petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 504, 506, 147, 148 and 149 of the Indian Penal Code and sections 27 and 37(b) of the Arms Act.
It is alleged that 35 to 40 miscreants reached the house of the informant and made indiscriminate firing. However, police rushed and nabbed co-accused Vinod who took name of the petitioner as an order giver. There is no allegation of assault or firing against the petitioner.
Learned counsel for the State as well as the informant oppose the prayer for bail.
Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned
Patna High Court CR. MISC. No.13805 of 2023(3) dt.26-06-2023 2/2 above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in Singheshwar Police Station Case No. 149 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
