JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This is an application for grant of anticipatory bail in connection with Barh P.S. Case No. 247 of 2017, disclosing offences under Section 304(B)/ 34 of the Indian Penal code. Allegation against the petitioner, who happens to be the Devar of the deceased, and other accused persons of causing death of the deceased.

Submission of learned counsel for the petitioner is that marriage was solemnized before ten years ago and as such there is no occassion of Section 304(B) of the Indian Penal Code and allegations are general in nature. Further submission of learned counsel for the petitioner is that petitioner is living separately from the husband of the deceased.

Having heard both sides, in view of the facts and

No.19038 of 2019(2) dt.06-05-2019 2/2 circumstances as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/-( Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Barh (District- Patna) in connection with Barh P.S. Case No. 247 of 2017, subject to that condition that laid down under Section 438(2) of the Code of Criminal Procedure.
