The petitioners seek quashing of the order dated 15.11.2014 by which the prima facie case under Sections 417, 423, 323, 465 and 504 was found against the petitioners and directed to issue summon against the accused persons. Learned counsel for the petitioners submits that the order is illegal.

Patna High Court Cr.Misc. No.2800 of 2015 (2) dt.18-03-2017 2/2 I find that the learned Judicial Magistrate has perused the records and only thereafter passed an order under Section 204 of the Code of Criminal Procedure to summon the accused persons.

Therefore, I do not find any illegality in the order. Accordingly, this quashing petition is dismissed. The petitioners may raise all the points at the time of framing of charge. (Prabhat Kumar Jha, J) Mishra/- U T
