The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

Total 396 liters of Nepali Saufi wine has been recovered from a pick-up van and petitioner was named by the local chowkidar, as the person, who was driver of the said vehicle and fled away after seeing the police party. It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the vehicle in question and he has been made accused in this case only on suspicion. Petitioner has got clean antecedent.

No.14949 of 2022(2) dt.15-07-2022 2/2 Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, Sitamarhi in connection with Kanhauli P.S. Case No. 106 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
