JUSTICE ARUN KUMAR ORAL ORDER 20-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Gogri PS Case No. 345 of 2017 registered under Sections 25(1-AA), 29, 31, 26 and 35 of the Arms Act.

The allegation in brief is that mini gun factory and explosive was being run by the accused persons and the petitioner was apprehended on the spot.

Learned Counsel for the petitioner submits the petitioner is in custody for the last eight months, he was only standing there and the factory was being run by some other co-accused. Learned Counsel for the State submits that the petitioner along with others was apprehended on the spot and several materials and machines for making gun and explosives were recovered. Having considered the said facts and circumstances, the prayer for bail of the petitioner is rejected at present. The trial court is directed to expedite the trial and preferably conclude the same within a period of six months after framing of the charge.
