The petitioners apprehend their arrest in Fatuha P.S. Case No. 233 of 2014, registered for the offences punishable under Section 379 of the Indian Penal Code and Sections 3(X) of the SC/ST Act.

The informant alleged that the petitioners forcible stopped him on the road and Raja Yadav abused the wife of the informant by naming her caste and dragged her out from the motorcycle. It has further been alleged that the other accused persons snatched chain and money.

Learned counsel for the petitioners submits that petitioner no. 1 Ashok Yadav lodged Fatuha P.S. Case No. 232 of

Patna High Court Cr.Misc. No.1944 of 2015 (2) dt.16-01-2015 2014 against the informant Vicky Kumar and others for assaulting and snatching his money while he was plying auto rickshaw. The case of the petitioner was earlier lodged. There is allegation against Raja Yadav that he abused the wife of the informant by naming her caste.

Considering the facts aforesaid and the fact that the case of the petitioner was earlier filed and the present case was lodged later on with allegation of assault and snatching, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri D.K. Mishra, the learned Judicial Magistrate, Patna City in connection with Fatuha P.S. Case No. 233 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
