The petitioner seeks bail in Chandan P.S. Case No. 179 of 2017 registered under Section 30 (a) (g) and 32 (2) of the Bihar Prohibition and Excise Act, 2016. 52 liters of foreign liquor is said to have been recovered from a Maruti Suzuki car and three persons including the petitioner sitting in the said vehicle were apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. Petitioner happens to be the driver of the said vehicle and was transporting the carton at the instruction of its owners Pappu Singh and Jawahar Sah

Patna High Court Cr.Misc. No.9140 of 2018 (02) dt.17-02-2018 2/ 2 being unaware of its contents. Though four cases have been lodged against the petitioner but he is on bail in all the aforesaid cases. He has been languishing in custody since 06.11.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge Excise, Banka in connection with Chandan P.S. Case No.179 of 2017.
