JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This is an application for grant of anticipatory bail in connection with Manigachhi P.S. Case No. 143 of 2017, disclosing offences under Sections 498(A)/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Case is under Section 498(A) of the I.P.C. and it appears that after appearance of opposite party no.2, the case was sent to Mediation Committee vide order dated 06.03.2019 and it appears from Mediator's report, which is at Flag 'M', that the dispute between the parties have been resolved through the process of mediation and the terms of settlement mutually agreed upon the parties.
Heard learned APP as well as learned counsel for the
Patna High Court CR. MISC. No.13891 of 2019(3) dt.06-05-2019 2/2 opposite party no.2, they have not controverted the above fact. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below on 03.06.2019 and on that date, opposite party no.2 shall also remain present and both the parties will abide by terms of agreement which is attached with Mediator's report, and on surrender, the petitioner shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Darbhanga, in connection with Manigachhi P.S. Case No. 143 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
Let a copy of the Mediator's report along with the memorandum of agreement be sent to the learned court below for needful.
