The petitioner apprehends his arrest in Complaint Case No. 1851 C of 2013, registered for the offences punishable under Section 498A and other Sections of the Indian Penal Code. The complainant alleged that she was married in the year 2008, but immediately after marriage her husband and others subjected her to physical and mental torture and on 09.06.2013 the accused persons assaulted her and drove her out after snatching her ornaments and belongings.
The petitioner-husband submits that the allegations are false. The wife does not want to live with the petitioner. She
Patna High Court Cr.Misc. No.1941 of 2015 (2) dt.16-01-2015 did not complain about ill treatment at the hands of the petitioner. When the complainant did not agree to live with the petitioner, the petitioner filed a divorce case No. 177 of 2013 on 27.06.2013. The complainant knew about the filing of the divorce case and then she filed complaint on 17.07.2014.
Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Begusarai in connection with Complaint Case No. 1851 C of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
