The petitioner apprehends his arrest in connection with Complaint Case No.1526 of 2019 for offences under Sections 498A and 506 of the Indian Penal Code. At the very outset, learned counsel for the petitioner has pointed out that there is a mistake that one case of 2009 could not be mentioned in paragraph 2 of this application. The petitioner is also ready to offer maintenance amount of Rs.4000/- per month to the opposite party no.2.

Patna High Court CR. MISC. No.23623 of 2021(4) dt.02-03-2022 2/3 It has been submitted that this is a case of matrimonial dispute and there are allegations and counter allegations which cannot be decided in this proceeding.

Considering the above and considering the offer of the petitioner to pay the maintenance during the pendency of the criminal case and in view of the law laid down by the Apex Court in the case of Arnesh Kumar V State Of Bihar reported in (2014) 8 SCC 273, this application for anticipatory bail is allowed.

Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Danapur, Patna in connection with Complaint Case No.1526 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

If the petitioner fails to pay the maintenance of Rs.4000/- (Rupees four thousand) per month to opposite party no.2 beginning from the month of March, 2022, then the bail bond of the petitioner shall stand cancelled. The opposite party no.2 shall provide the details of
