2. The petitioner apprehends his arrest in a case registered for the offence under Sections 126(2), 115(2), 352, 351(2), 109, 3(5) of the Bhartiya Nyaya Sanhita, 2023, Section 27 of the Arms Act and Section 37 of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, on 29.11.2024 at about 21.40 PM while informant was on patrolling duty, he received an information that two families are scuffling at village Beli, and as such, he along with other police personnel reached at the place of occurrence and saw that some accused carrying arms and abusing each other, but on seeing the police force, they fled

No.20489 of 2025(3) dt.23-06-2025 2/3 from the place of occurrence but one person was apprehended, who disclosed his name as Rajesh Kumar Singh, and also disclosed that co-accused Mithun Kumar Singh abused and fired at him on account of political rivalry, but missed, further on hearing the sound of gunshot, people started gathering when Mithun fled away. It is further alleged that again, Mithun along with his brother came at his door carrying arms and abused him in drunken condition.

Learned counsel for the petitioner submits that from bare perusal of F.I.R., it is apparent that a bald allegation has been levelled against petitioner and others because of political rivalry and entire family members have been implicated. There is no allegation of assault against against this petitioner. Similarly situated three persons have already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 06.03.2025 passed in Cr.Misc. No. 8171 of 2025. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail
Patna High Court CR. MISC. No.20489 of 2025(3) dt.23-06-2025 3/3 on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Second, Aurangabad / concerned Court in connection with Fesar P.S. Case No. 136/2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
