2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 302, 307, 504 and 506 of the Indian Penal Code and section 27 of the Arms Act.

3. Learned counsel appearing for the petitioner submits that the specific allegation of firing is against other accused persons and no overt act has been alleged against this petitioner. Co-accused, with similar allegation, has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No. 12676/2024. Petitioner claims clean antecedent.

5. Learned counsel for the State as well as the informant oppose the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest or surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of

Patna High Court CR. MISC. No.16269 of 2024(2) dt.21-03-2024 2/2 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram in Sasaram Town Police Station Case No. 707 of 2023, subject to the conditions laid down under section 438(2) of the Cr.P.C.
