Petitioner, already in custody, seeks bail in connection with Chiraiya P.S. Case No.185 of 2017, registered under Sections 413 and 414/34 of the Indian Penal Code. Allegation in brief is that one person Abdul Hai was apprehended with the stolen motorcycle and he disclosed the name of the petitioner as one of the associates who escaped away.

Learned counsel for the petitioner submits that the motorcycle was not recovered from possession of the petitioner and there is no other material against the petitioner in the present case except that he has a few criminal antecedents, however the petitioner is in custody since 29.01.2018.

No.21068 of 2018(2) dt.11-04-2018 2/2 Having considered the aforesaid facts and circumstances, petitioner Osaid Alam @ Doctor is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Sikrahana at Dhaka, East Champaran at Motihari in connection with Chiraiya P.S. Case No.185 of 2017.
