The petitioners seek anticipatory bail in a case instituted for the offences under Sections 342, 323, 354(A) and 504/34 of the Indian Penal Code and Section 3⁄4 of the Dayan Act. There is allegation that accused persons have assaulted the informant and have treated him as Witch (Dian). There is allegation that they have assaulted the informant by fists and slaps including rod.

Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let

Patna High Court Cr.Misc. No.11737 of 2016 (2) dt.16-03-2016 petitioners, namely, Amit Ram, Gauri Ram alias Gori Ram, Bishun Ram, Mukesh Ram and Umesh Ram, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Banka in connection with Shambhuganj P.S. Case No.3 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal procedure.
