JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 272 and 273 of the Indian Penal Code and 30 (a) of Bihar Prohibition and Excise Act, 2016.

As per prosecution case, 10.4 liters of country made wine is said to have been recovered from the house of the petitioner.

It is submitted by the learned counsel for the petitioner that the petitioner was not arrested at the spot. It is further submitted that no incriminating article has been recovered from his conscious possession. House from where country made liquor was recovered is a joint family house. The petitioner is in custody since 26.03.2017.

No.26399 of 2017 (2) dt.12-06-2017 2/2 Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Rohtas at Sasaram in connection with Nauhatta P.S.Case No. 07 of 2017.
