Petitioner, already in custody, seeks bail in connection with Town P.S. Case No.847 of 2017, registered under Sections 272 and 273 of the Indian Penal Code as well as under Sections 30(a) and 38(2) of the Bihar Prohibition of Excise Act, 2016. Allegation is that 24 bottles of foreign liquor was being transported keeping it under the back seat of the tempo. Learned counsel for the petitioner submits that the petitioner was passenger and not knowing about liquor being carried away by the tempo driver, petitioner is in custody since 14.11.2017 and he has clean antecedent.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.3764 of 2018(2) dt.30-01-2018 2/2 petitioner Rajat Babu is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge cum Special Judge, Excise, Muzaffarpur in connection with Town P.S. Case No.847 of 2017.
