JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 147, 148, 149, 341, 323, 307, 353, 188, 283,337, 153(a), 427 of the Indian Penal Code, 27 of Arms Act and Section 3 / 4 of Explosive Substance Act.
As per prosecution case, there was a communal riot. Petitioner happens to be a member of one of the community. He is said to have pelted stone, resorted to firing and exploded bomb. It is submitted by the learned counsel for the petitioner that the allegation leveled against the petitioner is not specific rather general and omnibus in nature. No one has sustained injury. The petitioner is languishing in custody since 06.04.2017. other co-accused persons have been enlarged on bail vide Cr. Misc.
Patna High Court Cr.Misc. No.26404 of 2017 (2) dt.12-06-2017 2/2 No. 24018 of 2017 by this Court.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawadah in connection with Nawada P.S.Case No. 200 of 2017.
