====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 09-03-2022 Heard learned counsel for the petitioners and learned APP for the State.

The petitioner No.2 is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 302, 147, 504, 148, 149 of the Indian Penal Code.

The prosecution case as per F.I.R is that all the F.I.R named accused persons including the petitioner No. 2 came at the door of the informant and assaulted son of the informant who subsequently succumbed to the injuries. It is specifically alleged against petitioner No. 2 that he assaulted with iron rod on the head of the cousin brother of

It is submitted by learned counsel for the petitioner No. 2 that there is general and omnibus allegation against him. There is no allegation against petitioner No. 2 to have assaulted the deceased. Moreover, the injury report of injured Vijay Rai is not on record. A statement has been made in para 3 of the petition that petitioner No. 2 has no criminal antecedent.

Considering the aforestated facts, let the petitioner No. 2, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 13th, Saran at Chapra in connection with Doriganj P.S. Case No. 193 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
