IN THE HIGH COURT OF JUDICATURE AT PATNA
Criminal Miscellaneous No. 10630 of 2016 Arising out of P.S. Case No. - 27 Year - 2015 Thana - AMNAUR District - SARAN ====================================================== Ranjay Kumar Pathak, Son of Late Mahesh Pathak, Resident of Village - Bhatgiee, Police Station Amnour District - Saran at Chapra .... .... Petitioner
Versus
The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner : Mr. Pramod Ban Bihari Singh, Advocate For the Opposite Party : Mr. Kanhaiya Kishore, A.P.P. ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 27-07-2016 Heard both sides.
The petitioner apprehends his arrest in Amnour P.S. Case No. 27 of 2015 registered for the offences punishable under Sections 420, 406 of the Indian Penal Code and Section 138 of the Negotiable Instrument Act.
The prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 15.12.2015 passed in Cr. Misc. No. 37143 of 2015.
Petitioner made second attempt for grant of anticipatory bail on the ground that during the investigation none of the witnesses has stated that the petitioner was working at the Service Centre of the informant, but it appears that the informant has very categorically alleged that the petitioner was working at his Service Centre and he collected Rs.3,48,000/- from the
Patna High Court Cr.Misc. No.10630 of 2016 (2) dt.27-07-2016 2/2 different customers and did not pay the informant then the informant demanded money. The petitioner issued eight cheques worth Rs.3,48,000/- and on presentation of the aforesaid cheques all were dishonoured.
Considering the facts, I am not inclined to enlarge the petitioner on anticipatory bail which has already been earlier rejected and the same is again rejected.
