No one appears for State.
The petitioners in the present case are seeking regular bail in Sasaram (Darigaon) P.S. Case No. 525 of 2017 under Sections 272 and 273 of the Indian Penal Code and Section 30(a) and 41 of the Bihar Excise and Prohibition Act, 2016. Learned counsel for the petitioners submits that the petitioner is falsely implicated in the present case under Section 30(a) and 41 of the Bihar Excise and Prohibition Act, 2016. Learned counsel further submits that the Bolero from which seizure has been made does not belong to the present petitioners and in fact the seizure itself is in violation of Section 100 of the
Patna High Court Cr.Misc. No.27461 of 2017 (2) dt.01-07-2017 2/2 Code of Criminal Procedure. He further submits that the petitioners have no criminal antecedent and are languishing in jail since 24.04.2017.
Considering the facts and circumstances of the case and the submissions on behalf of the petitioners as also that the petitioners have no criminal history and are in jail for over two months, let the petitioners, namely, Lala Bind and Satendra Dubey be enlarged on bail on thier furnishing bail bonds of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Spl. Judge, Excise Act, Rohtas at Sasaram in Sasaram (Darigaon) P.S. Case No. 525 of 2017, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
