Mr.Humayou Ahmad Khan ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 13-05-2026 Heard learned counsel for the petitioner and learned APP for the State in both the aforesaid cases.
2. The petitioner of both the aforesaid cases seeks bail in connection with Athmalgola P.S. Case No. 192 of 2025 registered for the offence punishable under Sections 103(1),
Patna High Court CR. MISC. No.13223 of 2026(3) dt.13-05-2026 2/3 61(2), 351(2) and 352 of the B.N.S..
3. As per prosecution case, it is alleged that on 30.05.2025, brother of informant, along with his friend, went to the neighboring village where, all the F.I.R. named accused persons, including these petitioners, intercepted him and committed murder of brother of informant.
4. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. She further submits that the informant is not an eye witness of the alleged occurrence and there is general and omnibus allegation against the petitioners. She also submits that the petitioners have no criminal antecedent. She next submits that the co-accused namely Rajaram Mahto and Laxman Mahto have already been granted bail by this Court vide order dated 14.10.2025 passed in Cr. Misc. No. 70030 of 2025. The petitioners are in custody since 4.6.2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, period of custody of the petitioners and clean antecedents of the petitioners, both the aforesaid bail applications are allowed.

7. Accordingly, let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned concerned Court below in connection with Athamalgola P.S. Case No. 192 of 2025.
8. As a condition of this order, the petitioners, after being released on bail, is directed to co-operate in the trial either by appearing personally or through their lawyer in the trial Court on each and every date fixed by the trial Court. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioners.
9. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioners at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
