The petitioner seeks bail in connection with Dedarganj P.S. Case No.164/2017 (Special Case No.6868 of 2017) registered under Sections 30(a)/36 of Bihar Prohibition and Excise Act, 2016.
63 liters of foreign liquor is said to have been recovered from Tata Indigo and the petitioner was apprehended. The petitioner happens to be the driver of the said vehicle and three other accused persons sitting in the vehicle apprehended. It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.7837 of 2018 (2) dt.13-02-2018 2/2 the petitioner happens to be the driver of the vehicle. He had no knowledge of the seized liquor being carried by the accused persons sitting in the vehicle. The petitioner has been falsely implicated in this case. The co-accused namely Vikash Kumar has been enlarged on bail by co-ordinate Bench of this court in Cr. Misc. No.62308 of 2017 vide order dated 11.01.2018. The petitioner has been languishing in custody since 10.10.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Didarganj P.S. Case No.164/2017 (Special case No.6868/2017).
