Petitioner seeks bail in Bhadwar P.S. Case No.05 of 2018 instituted for the offence under Section(s) 302 Indian Penal Code.

It is alleged in the written report that daughter of the informant was married with this petitioner, but no child was born after marriage on account of which altercation took place. It is alleged that on 23.02.2018 son-in-law of the informant informed that his daughter is traceless. He went to Sasural of his daughter and found that son-in-law and his other family members were quarreling and they were speaking that they will kill the lady. He returned to his house. At about 7.00 PM he received information on telephone that her daughter has been done to death in Sasural by giving poison. He went to Sasural of his daughter and found his daughter lying dead.

Patna High Court CR. MISC. No.12593 of 2019(5) dt.03-07-2019 2/2 Counsel for the petitioner submits that Petitioner is in custody since 06.10.2018. There is no eye witness to the occurrence. In the written report, the informant has said that when he reached Sasural of his daughter he found petitioner and his other family members were quarreling. He has not levelled any allegation that his son-in-law was misbehaving with his daughter.

FSL report has been received, wherein, it is mentioned that death has been caused due to consuming of celphos.

In the written report, general and omnibus allegation has been levelled against the petitioner.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Sherghati, Gaya, in connection with Bhadwar P.S. Case No.05 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
