JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner and the State. The petitioner being father of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304(B), 328/34 of the Indian Penal Code.

The prosecution case is killing of the daughter of the informant after one year of marriage due to non-fulfillment of demand of dowry either by assaulting or administering poison. It is submitted by the learned counsel for the petitioner that post-mortem report does not reflects any external or internal injury nor resisting injury has been found during the post-mortem. The husband of the victim is in custody. The petitioner is an old man and claims to be separate from the husband of the victim. Case No. 91 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
