The petitioner is in custody in connection with Bhagwanpur P.S. Case No.154 of 2017, a case under Sections 302/201/34 of the Indian Penal Code.
After about fifteen years of marriage the wife of this petitioner died in suspicious circumstance. Allegation is of demand of dowry and torture for the same.
Submission is that there are grown-up children out of the wedlock of the deceased. There is no presumption of dowry death against the petitioner. For petty dispute the victim committed suicide.
Considering the aforesaid facts, let the petitioner,
Patna High Court Cr.Misc. No.9103 of 2018 (2) dt.16-02-2018 P2/ above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
