JUSTICE DINESH KUMAR SINGH ORAL ORDER 06/ 07-01-2015 The present application has been filed for modification of order dated 11.07.2013 passed in Cr. Misc. No. 20710 of 2013, whereby petitioner was granted provisional bail on the undertaking to supply the rice to F.C.I. due against the petitioner in lieu of the paddy already supplied. It is submitted by learned counsel for the petitioner that in spite of the notice by the learned court below none appeared on behalf of BSFC and petitioner's offer to supply the rice was not accepted by the authorities of State Food Corporation.
It is submitted by learned Senior Counsel Mr. Pradhan that the cut off date for supply of the rice is over, hence, now the petitioner may be directed to deposit the cash amount
Patna High Court Cr.Misc. No.20458 of 2014 (06) dt.07-01-2015 2/2 against the quantum of the rice to be supplied. In the circumstances, the petitioner is permitted to deposit 15% of the total amount due against the petitioner before the learned court below within a period of eight weeks, which will be invested in some fixed deposit scheme, which will be subject to the result of the case. On deposit of the aforesaid amount, the provisional bail granted to the petitioner vide order dated 11.07.2013 passed in Cr. Misc. No. 20710 of 2013 in connection with Deo P.S. Case No. 140 of 2012 pending in the court of learned Chief Judicial Magistrate, Aurangabad will be confirmed by the learned court below.
The order dated 11.07.2013 is modified to the extent indicated above.
Accordingly, this modification application is disposed of.
