The petitioner, mother-in-law of the deceased, is in judicial custody since 10.04.2017 in connection with Parsa P.S.Case No. 95 of 2013 for the offences alleged under Sections 304(B) and 201/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant is that his niece was married to one Mothilesh Rai and due to non fulfillment of demand of motorcycle she has been done to death by in-laws who disposed of her dead body.

It has been submitted by the learned counsel for the petitioner that she is innocent and has been falsely implicated in the aforesaid case. He further submits that general and omnibus

Patna High Court Cr.Misc. No.27559 of 2017 (3) dt.27-07-2017 2/2 allegations have been levelled against her. She is living separate for last ten years. It is further submitted that the charge sheet has already been submitted. Brother-in-law and his wife have been granted privilege of anticipatory bail in Cr. Misc. No. 46707 of 2015 on 02.11.2015.

However, learned A.P.P. for the State opposes the prayer for bail.

Be that as it may, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran in connection with Parsa P.S.Case no. 95 of 2013, subject to the condition that both the bailors would be close relative of the petitioner with sufficient immovable property within the jurisdiction of the concerned police station/court, who will file an affidavit stating their relationship with the petitioner and the petitioner will appear before the court below during trial on each and every date and failure to appear on two consecutive dates without assigning any reason will entail cancellation of her bail bonds.
