JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2019 The petitioner has filed this application for cancellation of anticipatory bail of the opposite party no. 2 granted vide order dated 16.01.2019 passed in Criminal Miscellaneous No. 1047/2019 on the ground that this court on the basis of submission of learned counsel for the petitioner relying on Annexure -2 has granted the privilege of anticipatory bail to the opposite party no. 2 but on enquiry, the allegation was found true and Annexure -2 was with respect to different year. As such by placing wrong facts, opposite party no. 2 obtained anticipatory bail.

Having heard both sides, from perusal of the record, it
Patna High Court CR. MISC. No.14536 of 2019(2) dt.27-03-2019 2/2 appears that opposite party no. 2 has referred Annexure -2 as one of the instances that earlier also similar allegation was made and on enquiry, the Block Development Officer has not found the same true and considering the same, anticipatory bail was granted to opposite party no. 2, as such, I am not inclined to interfere with the order dated 16.01.2019 passed in Cr. Misc. No. 1047 of 2019.
This application is accordingly dismissed.
