15-06-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are seeking Regular Bail in connection with Nawadah Town P.S. Case No. 200/2017 for offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 188, 283, 337, 153(A)/427 of the Indian Penal Code and 27 of the Arms Act and 3/4 of Explosive Substance Act.

Learned counsel for the petitioners submits that a bare perusal of the First Information Report would show that there was a free fight among the members of the two communities on the occasion of religious ceremony.

Patna High Court Cr.Misc. No.25993 of 2017 (2) dt.15-06-2017 Members of both the communities have been named in the First Information Report with general and omnibus allegations against all of them. He would further submits that these petitioners have no criminal antecedent and the co-accused in the present case have been granted regular bail vide Cr. Misc. No. 24018/2017.

The learned Additional Public Prosecutor opposes the prayer for bail of these petitioners. Considering the nature of allegation and the fact that a coordinate Bench of this Court has allowed the privilege of regular bail to the co-accused, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Nawadah Town P.S.
