This is an application for bail in connection with Riga P.S. Case No. 234 of 2013 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is not named in the FIR and later on his name transpires during course of investigation.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case on the basis of suspicion and there is nothing against him. Further submission is that similarly situated co-accused persons have been granted bail in Cr.Misc.No. 25746 of 2014, vide order dated 2.9.2014, Cr.Misc.No. 51635 of 2015, vide order dated 30.1.2016 and in Cr.Misc.No.7122 of 2015, vide order dated 20.2.2015 and he is in custody since 20.2.2016.

Having heard both sides and in view of facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No. 234 of 2013, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear in court on each and every date fixed in the case and on failure to appear without any genuine ground or without permission of court, his bail bond shall be cancelled.
