JUSTICE RAMESH KUMAR DATTA ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The writ application has been filed seeking a direction upon the respondents to give benefit of 1st and 2nd ACP, 6th Pay Revision and arrears of leave encashment amount as also interest on the same to the petitioner.

In the counter affidavit filed on behalf of the respondents, it is stated that the dues of the petitioner under the three heads were calculated and they were found to be Rs. 1,73,367/- and the bill for the same was submitted before the Treasury but the same could not be paid as the GPF account of

Patna High Court CWJC No.2061 of 2015 (2) dt.08-09-2016 2/2 the petitioner was not entered in the Treasury and the correspondences with the Treasury Officer in this regard has not brought any fruitful result.

In the above circumstances, the writ application is disposed of with a direction to the respondents to ensure that the amount of Rs. 1,73,367/- due and payable to the petitioner is paid to the petitioner within a period of two months from the date of receipt/production of a copy of this order.

Upon failure to pay the same within the said period, the amount shall carry interest at the rate of 8% per annum which interest the State Government shall be entitled to recover from the employee who would be responsible for the delay in the matter.
