The petitioner apprehends his arrest in Jehanabad (Mahila) P.S. Case No. 57/2015, registered for the offences punishable under Sections 304B, 34 of the Indian Penal Code. The informant alleged that his daughter was married to Lal Babu Sharma in the year 2012. Second marriage was performed in the year 2015 and immediately thereafter his daughter was burnt to death. The informant came to know about the occurrence on 10.07.2015. Her dead body was found in Jehanabad hospital.

It is submitted that the petitioner is brother-in-law of the deceased. There is no allegation against the petitioner that petitioner ever tortured the deceased. He has no manner of concern

Patna High Court Cr.Misc. No.21024 of 2016 (5) dt.20-07-2016 2/2 with the family affairs of the husband of the deceased. Malti Devi, mother-in-law of the deceased has already been granted anticipatory bail vide order dated 13.05.2016 passed in Cr. Misc. 6620/2016. It appears that petitioner is brother-in-law of the deceased and the case of the petitioner stands on the same footing as that of Malti Devi, mother-in-law who has already been granted anticipatory bail.

Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the I/c Chief Judicial Magistrate, Jehanabad in connection with Jehanabad (Mahila) P.S. Case No. 57/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
