====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 19-01-2022 Heard learned counsel for the petitioner and learned APP for the State.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

It is alleged against the petitioner that he came at the door of the informant along with other accused persons and forcibly abducted the minor daughter of the

Patna High Court CR. MISC. No.24148 of 2021(2) dt.19-01-2022 2/2 informant. The impugned order reflects that in para 40 of the case diary, the victim has recorded her statement under Section 164 Cr.P.C where she has specifically alleged against the petitioner and three others to have committed rape on her. The medical report also corroborates the prosecution version. The witnesses have also supported the prosecution version.

It is submitted by learned counsel for the petitioner that the petitioner was in love with the victim girl and she left her house of her own goodwill. Considering the fact that there is direct allegation against the petitioner and the victim has also supported the prosecution version, this Court is not inclined to grant anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
