====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 17-11-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Petitioners seek bail in connection with Rajoun P.S. Case No. 501 of 2020 registered for the offences punishable under Sections 392/411 of the Indian Penal Code. According to prosecution case, on 16.12.2020 the informant was going to his village Gopalpur on motorcycle but near Katoriya Bridge three persons surrounded him and on the point of gun snatched Rs. 17,700/- in cash and Vivo mobile and fled away.

Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence and they

Learned counsel further submits that there is no recovery from possession of the petitioners and they are in custody since 18.12.2020 having clean antecedent. It is further submitted that co-accused Rajesh Bind has been granted bail by a co-ordinate Bench of this court vide order dated 23.09.2021 passed in Cr. Misc. No. 25468 of 2021.

The learned Additional Public Prosecutor opposed the prayer of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No. 501 of 2020, subject to the condition as laid down under Section 437(3) Cr.P.C.

And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner.
