2. The petitioner seeks bail in connection with Khanpur P.S. Case No. 130 of 2023 registered for the offences punishable under Sections 147, 148, 149, 224, 341, 342, 323, 337, 307, 332, 333, 504 of the I.P.C., Section 27 of the Arms Act and Section 45 of the Bihar Prohibition and Excise (Amendment) Act 2018.
3. As per prosecution case, informant and police official went to arrest FIR named accused persons Rajesh Kumar and other. It is further alleged that family members of the accused persons came to rescue the apprehended persons and attacked police party with lathi, danda and iron rod and they were successful to rescue the apprehended persons from the
Patna High Court CR. MISC. No.13144 of 2025(2) dt.04-04-2025 2/2 clutches of the police. Petitioner is alleged to be one among them who is said to have assaulted the informant and police official.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that there is no specific allegation against the petitioner rather the same is general and omnibus in nature. He further submits that co-accused, Rajesh Kumar, has already been granted bail vide Cr. Misc. No. 51207 of 2023 by a co-ordinate Bench of this Court. Petitioner is in custody since 08.01.2025.
5. Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner.
6. Considering the facts and circumstances of the case, period of custody and co-accused has already been granted bail, let the petitioner above named be released on bail, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Excise)-01, Samastipur in connection with Khanpur P.S.
