The petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Section 30(a) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 19.01.2022, charge-sheet has been submitted in the case and has antecedent of two cases. Allegation is of recovery of 59 litre of liquor from a Bikram vehicle.

The learned counsel for the petitioner submits that petitioner was not arrested from the spot rather his name came in the confessional statement of co-accused Dev Shankar Rai, which has no evidentiary value.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and his name came in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jandaha P. S. Case No.17 of 2022.

The application stands allowed.
