JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Laheri P.S. Case No. 232 of 2016, registered under Sections 363 and 366(A)/34 of the Indian Penal Code.

On the basis of written report of Sita Kumari, Laheri P.S. Case No. 232 of 2016 was instituted against two persons, namely, Amrita Kumari and Sourav Kumar.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation, the name of the petitioner has come in the confessional statement of co-accused, Sourav Kumar. The statement of the victim

Patna High Court Cr.Misc. No.24347 of 2017 (3) dt.29-06-2017 recorded under Section 164 of the Cr.P.C., in which, she has not disclosed the name of this petitioner having hand in any manner. It is further submitted that petitioner has no criminal antecedent and is in custody since 18.12.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Laheri P.S.
