The petitioner seeks regular bail in connection with Baligawn P.S.Case No.39 of 2015, registered for offences punishable under Sections 147, 148, 149, 435, 427, 387 and 506 of the Indian Penal Code.

The petitioner is named in the F.I.R. and it appears that his name transpired on the confession of the o-accused. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and the petitioner is accused in custody for about 2 1⁄2 months as well as the other accused persons, having similar allegation, have already been granted bail by this Court, vide order dated 18.4.2016 passed in Cr. Misc. No.15508 of 2016, order dated 30.08.2016 passed in Cr.

Patna High Court Cr.Misc. No.31962 of 2017 (3) dt.31-07-2017 2/2 Misc. No.26975 of 2016 and order dated 14.12.2016 passed in Cr. Misc. No.43327 of 2016.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIIth, Vaishali at Hajipur in connection with Baligawn P.S.Case NO.39 of 2015. With following conditions :

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, otherwise, his bail bond shall be cancelled.
