The petitioner is apprehending his arrest in connection with Vidyapatinagar P.S.Cae No.96 of 2009, dated 20.8.2009 , registered for offences punishable under Section 379 read with Section 34 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is of theft of the documents including that of the petitioner.
Submission of the learned counsel for the petitioner is that prior to that he had been transferred from that place and in spite of that he has been falsely implicated in this case. The police even after investigation has not found the case true against the petitioner, however, the cognizance has been taken. The aforesaid fact will appear from the impugned order.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Dalsingsarai in connection with Vidyapatinagar P.S.Case no.96 of 2009 dated 20.8.2009, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
