The petitioner has preferred this application for grant of regular bail in a case registered under sections 363, 366A and 34 of the Indian Penal Code.

As per the prosecution case, it is stated that the petitioner who had come in the neighbourhood of the informant took away his minor daughter on the pretext of marriage. The other accused persons named in the F.I.R. have a hand in the occurrence.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations are false and concocted. The daughter of the informant returned and her statement was recorded under

Patna High Court CR. MISC. No.25108 of 2021(3) dt.21-12-2021 2/2 section 164 Cr.P.C. wherein she has categorically stated that she went alone out of her own free will as she was close to the petitioner and married the petitioner. It is further submitted that no overt act whatsoever has been alleged by the daughter of the informant against this petitioner in the statement under section 164 Cr.P.C. The petitioner is in custody since 17.12.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the contents of the statement of the daughter of the informant under section 164 Cr.P.C. and the petitioner having remained in custody for 1 year, the Court directs the petitioner to be enlarged on bail in connection with Basantpur P.S. Case no.487 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan.
