JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307 and 379 of the Indian Penal Code.

It is alleged that on the order of the petitioner Santosh Kumar @ Santosh Kumar Jha, Lalan Jha, Phoolan Kumar Jha and petitioner Lalit Jha assaulted the informant with iron rod when other accused persons assaulted the co-villagers and the informant. It is submitted by learned counsel for the petitioners that the injury report is not on record. A statement to that effect has been made in para 11 of the petition. The informant has subsequently retracted from his initial version and filed a petition to that effect before the learned court below. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.DJ.M., Pupri at Sitamarhi in connection with Pupari P.S. Case No. 180 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
