The petitioner apprehends his arrest in Sessions Trial No. 435 of 2010, arising out of Sono (Charkapathar) P.S. Case No. 29 of 2003, registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.
The informant made allegation that Binod Pandey and Nandu Vishwakarama, the petitioner were working near her house. Binod Pandey kidnapped his daughter for marriage. Nandu Vishwakarama also accompanied Binod Pandey.
It is submitted that the victim made her statement under Section 164 of the Cr.P.C. but she did not complain any ill behaviour at the hands of the petitioner. The victim was in love with Binod Pandey.
Patna High Court Cr.Misc. No.1935 of 2015 (2) dt.16-01-2015 Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ad hoc Additional Sessions Judge-2, Jamui in connection with Sessions Trial No. 435 of 2010, arising out of Sono (Charkapathar) P.S.
