JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Arwal P.S. Case No. 01 of 2020 for the offence under Sections 447, 323, 324, 307, 354, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that on account of dispute over throwing of cow dung, scuffle took place and in the scuffle informant's side sustained injury. He further submits that there is allegation of assault against Shailendra Kumar and Abhishek Kumar and not against this petitioner.

Considering the fact that the petitioner has got no criminal antecedent and there is no specific overt act against this petitioner, the petitioner named above, in the event of arrest or

No.11957 of 2020(2) dt.05-03-2020 2/2 surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 01 of 2020 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
