The petitioner seeks bail in a case registered for the offence under Sections 121, 379, 414, 120B/34 of the Indian Penal Code, Sections 25(1-a), 25(1-aa), 25(1-b)a, 26, 35 of the Arms Act and Section 39 of the UAP Act.

Petitioner has been named in the F.I.R. on the basis of confessional statement of co-accused Md. Shamsher, wherein, he stated that this petitioner was one of his associates in hiding the bag containing five A.K.47 rifle.

It is submitted on behalf of petitioner that no arms or ammunition has been recovered from the possession of petitioner and only on the basis of confessional statement of coaccused and criminal antecedent, petitioner has been made

Patna High Court CR. MISC. No.36277 of 2021(5) dt.24-03-2022 2/2 accused in this case. Some of the similarly situated co-accused persons have already been granted bail by this Court, as per orders contained in Annexure 2 to 2/5 respectively. Petitioner is in custody since 05.11.2018.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Munger in connection with Mufassil P.S. Case No. 334 of 2018.
