JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner as well as learned counsel appearing for the Vigilance.
Petitioner apprehends his arrest in connection with Sheikhpura P.S. Case No. 266 of 2014 corresponding to Special Case No. 49 of 2014 registered for the offences punishable under Sections 419, 420, 467, 468, 471, 120B of the Indian Penal Code and Sections 7, 8, 9 and 10 of Prevention of Corruption Act. It appears that entire allegation centres round against co-accused, Gorelal Prasad and the petitioner is said to be compounder of a doctor in whose clinic the above stated coaccused, Gorelal Prasad being father of the petitioner used to come.
Patna High Court Cr.Misc. No.2818 of 2015 (2) dt.21-01-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance-II, Patna in Sheikhpura P.S. Case No. 266 of 2014 corresponding to Special Case No. 49 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
