ANJANA MISHRA ORAL ORDER 10-05-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with K. Nagar (Maranga) P.S. Case No.545 of 2015 for allegedly having committed the offence under Sections 302 and 120B of the Indian Penal Code.
Case diary in the present case was called for, which has since been received.
Learned counsel for the petitioner submits that the petitioner is wholly innocent and only because he is an associate of one Ran Vijay Singh, who is said to have having enmity for the last ten years with the informant and his family, that the name of the petitioner has been brought in connection with the present case.

No.11604 of 2016 (3) dt.10-05-2016 2/2 Learned counsel appearing for the State after perusal of the case diary submits that the only evidence which has come in the case diary is that the petitioner was seen eating and drinking with said Ran Vijay Singh. Save and except the aforesaid allegation, there is no further cogent evidence in the case diary to implicate the petitioner. The petitioner is also having no criminal antecedents.
Considering the aforementioned facts and circumstances and that the name of the petitioner has come only on suspicion, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Purnea, in connection with K. Nagar (Maranga) P.S. Case No.545 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
